We take your privacy very seriously. In this privacy policy, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy policy that you do not agree with, please discontinue use of our websites and our services.

This privacy policy applies to all information collected through our websites (such as https://knocommerce.com), and/or any related services, sales, marketing or events (we refer to them collectively in this privacy policy as the “Services“).

The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make and the products and features you use. The personal information we collect can include the following:

  • Publicly Available Personal Information. We collect first name, last name, and full name; business email; and other similar data.
  • Personal Information Provided by You. We collect data collected from surveys; app usage; and other similar data.
  • Personal Information obtained through technology integrations. We collect data from partner integrations (like Shopify and Klaviyo) in order to enhance your use of our products and services.
  • Log Files. We also may collect certain information by automated means when you use our Services, including your internet protocol (“IP”) address; information about your web browser software and version; if you arrived at the Services through a link from a third-party website, the uniform resource locater (“URL”) of the linking page; your mobile device identifier and other information about devices you use to access the Services; and information about your activity while using the Services, such as which pages you choose to view, queries you make using our “search” function, and other information about your account usage.
  • Advertising. We partner with third party ad networks to either display advertising on our web site and App or to manage our advertising on other sites. Our ad network partners use cookies or similar technologies to collect non-personal information about your activities on this and other web sites to provide you targeted advertising based upon your interests.

The personal information we may collect includes:

  • Contact information, such as your name, mailing address, email address, and telephone number;
  • Unique identifiers such as username and password;
  • Preferences information such as product and brand feedback, order history, and marketing preferences;
  • Certain other information you may provide to us in your communications or in connection with other products or services;
  • Order data, click data, and other potentially sensitive, identifiable customer data.

2. HOW DO WE USE YOUR PERSONAL INFORMATION?

In Short: We process your personal information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected via our Services for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations.

We indicate the specific processing grounds we rely on next to each purpose listed below.

We use the information we collect or receive:

  • To facilitate account creation and logon process. If you choose to link your account with us to a third party account (such as your Google or Shopify account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process for the performance of the contract.
  • To send administrative information to you. We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.
  • To deliver services to the user. We may use your information to provide you with the requested service.
  • To respond to user inquiries/offer support to users. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our Services.
  • To send Email Newsletters and Promotions. With your permission, we may use personal information about you to send you newsletters, exclusive offers and promotions, and product news through email. We also may use personal information about you to administer our promotions.
  • To obtain Feedback. We may use information you provide to us, regarding our products and services, to provide product feedback to our customers through the Services.
  • Other Uses of Information. We may use personal information to provide you with the products, services, and information that you request. We may also use personal information to perform business analyses or for other purposes to improve the quality of our business, our Services, and the products we offer. We may also use personal information about you for our internal purposes, including administering our Services, investigating possible violations of and enforcing our contracts, including our Terms and Conditions and any other terms and conditions associated with our products and services, and to comply with our legal obligations. In addition, we may use your personal information as otherwise described to you at the time of collection or with your consent.

3. WILL YOUR PERSONAL INFORMATION BE SHARED WITH ANYONE?

In Short: Your personally identifiable information will only ever be shared with your consent, or because it is required for legitimate business purposes.

We are committed to privacy and will not sell any personally identifiable information without explicit consent from the person who is sharing the personal information.

Here are the ways you can expect us to process or share your personal information:

  • With Explicit Consent: We may process your data if you have given us explicit consent to use your personal information for a specific purpose. For example, you may opt to share information with brands you shop and that information would then be shared with those brands.
  • Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests. For example, we may share anonymized survey response data as part of our product or service offerings.
  • Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
  • Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.
  • Vendors, Consultants and Other Third-Party Service Providers. We may share your data with third party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: payment processing, data analysis, email delivery, hosting services, customer service and marketing efforts. We may allow selected third parties to use tracking technology on the Services, which will enable them to collect data about how you interact with the Services over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content and better understand online activity. Unless described in this Policy, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes. We have contracts in place with our data processors. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will not share your personal information with any organization apart from us. They will hold it securely and retain it for the period we instruct.
  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Business Partners. We may share your information with our business partners to offer you certain products, services or promotions.

4. WHO WILL YOUR PERSONAL INFORMATION BE SHARED WITH?

In Short: We may share data with third parties for the purpose of enhancing your experience with our Services, and with integrated services.

We only share and disclose your personal information with third parties when necessary for enhancing the experience of our users. We have categorized each party so that you may easily understand the purpose of our data collection and processing practices. If we have processed your data based on your consent and you wish to revoke your consent, please contact us.

  • Integrated Services. Our Services rely heavily on sending data to, and receiving data from, 3rd party applications. This data ensures that we are providing you with the most accurate reporting and insights, and allows you to push data we collect to other platforms for use with their tools (i.e. Klaviyo).
  • Service Providers. We may share your personal information with service providers that perform functions or services on our behalf (such as to host websites, manage databases, perform analyses, send communications for us, provide you with live chat service, or provide other components of websites).
  • Analytics and Advertising. We may allow third parties to collect information in order to provide us with analytics. For instance, the Services may use analytics tools provided by Google to help us understand how people use the Services. You can learn more about how Google collects and uses information as a part of its tools at http://www.google.com/analytics/. This data collection includes (but is not limited to) Facebook Audience Network, Google AdSense, Google Analytics, and Shopify.
  • Legal Process. We may disclose your personal information to respond to subpoenas, court orders, or other legal process in response to a request for cooperation from law enforcement or another government agency, and to comply with our other legal obligations.
  • Protect our Services and Users. We may disclose your personal information if we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual illegal activity, or violation of our Terms and Conditions or other contracts.
  • Other Circumstances. We may disclose your personal information in other ways that are described to you at the point of collection or pursuant to your consent.

Personally identifiable information will not be sold to third parties.

5. WHAT NON PERSONAL INFORMATION DO WE COLLECT?

In Short: Non-personally identifiable information may be collected that can be disassociated from your personal information.

The following types of data may be collected and anonymized for use in our products and services:

  • Survey responses that do not include personally identifiable information. We have “aggregate” survey response data for questions like “how did you first hear about us?”, “What is your age”, etc. that can be disassociated from personal information and used to provide insight to our customers on a broader scale.
  • Order information that is not personally identifiable. Postal code, number of purchases, and price of purchase are examples of data that may be anonymized and used in aggregate for company products and services.
  • Company data that is not identifiable to a specific company. This may include state or province, company industry, company size (e.g. $1,000,000 – $5,000,000 annual revenue), or other similar information that cannot be associated to a specific company.

6. HOW DO WE USE THIS NON PERSONAL INFORMATION?

In Short: We reserve the right to use this non-personal, anonymized information in any capacity that enhances our products or services.

The following are some examples of how we may use this non-personal, anonymized information.

  • Benchmarking. We may use this anonymous information to give our customers the ability to understand how their data compares to that of their peers.
  • Recommendations. We may use this anonymous information to make recommendations to brands and customers who opt in for recommendations.
  • Industry reports. We may use this anonymous information to generate industry reports for the purpose of lead generation and education.
  • Partnerships. We may use this anonymous information to support and enhance our partnerships.
  • Data services. We may use this anonymous information for any data service.

This list should not be considered exhaustive, and should be viewed as examples of how we may use no- personal data, anonymized data.

7. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

Like many companies, we and our third party partners, such as advertising partners, marketing partners, and service providers, use certain technologies such as cookies and similar technologies. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis. You may be able to disable cookies by changing a setting in your web browser. Please note, however, that without cookies you may not be able to take full advantage of all the Services features.

8. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We keep your personal information indefinitely unless you advise us otherwise. In some cases data that is not personally identifiable may be included in data aggregations that remain after your personal data has been removed. This information can in no way be tied directly back to your personal information in that context.

9. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process.

Measures taken include (but are not limited to):

  • Actively working toward SOC2 compliance
  • Principle of least privilege. We practice the principle of least privilege and grant access to sensitive information on a case-by-case basis, and only when necessary to perform our services.
  • Locked down database. We employ firewalls, encryption, etc. to limit access to our database and ensure that no data can be accessed without a very high level of security.
  • We have 24/7 monitoring. We have systems in place to monitor for any potential cyber attack.

While we do our best to secure your data, please remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the services within a secure environment.

10. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 13 years of age.

We do not knowingly solicit data from or market to children under 13 years of age. By using the Services, you represent that you are at least 13 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 13 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 11. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your account at any time.

If you are using the Services from outside the United States and provide us with personal information, please note that your personal information will be transferred, stored and processed in the United States. The data protection laws in the United States may not be as comprehensive as those in your country of residence. By doing business or interacting with the Company and the Services, you are consenting to the transfer of your personal information to facilities located in the United States and other facility locations selected by the Company.

If you are resident in the European Economic Area and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. 12. HOW DO I ACCESS MY INFORMATION?

In Short: You have the right to access your personal information and we can share this information with you at your request.

Based on the laws of some countries, you may have the right to request access to the personal information we collect from you, change that information, or delete it in some circumstances. To request to review, update, or delete your personal information, please email hello@knocommerce.com, or submit a request through. We will respond to your request within 30 days.

How to Request Data

If you are a company using Shopify, you may also request data deletion using Shopify’s GDPR data requests. Any request in Shopify also triggers a request on our platform. As a Shopify partner we are required to automatically process those requests. In most cases data is deleted instantly, but please allow up to 30 days in case of a failed webhook request.

Any company not using Shopify, or any customer using the services of a company should reach out to hello@knocommerce.com to request access to information, or deletion of information.

Other types of information we may hold

  • Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. To opt-out of interest-based advertising by advertisers on our Services visit http://www.aboutads.info/choices/.
  • Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list – however, we will still need to send you service-related emails that are necessary for the administration and use of your account.

Account Deletion

Upon your request to terminate your account, we will deactivate your account but retain your data unless you explicitly request that we remove the data you’ve collected.

If you specifically request data deletion, we will remove any order and customer data that has been collected from the integrations you have enabled (i.e. Shopify), as well as any data that has been collected by you through our platform. In some cases you may have access to data that was not collected by you (i.e. benchmarking data), and that data will not be removed.

Some additional information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

13. DATA BREACH

A privacy breach occurs when there is unauthorized access to or collection, use, disclosure or disposal of personal information. You will be notified about data breaches when KnoCommerce Inc believes you are likely to be at risk or serious harm. For example, a data breach may be likely to result in serious financial harm or harm to your mental or physical well-being. In the event that KnoCommerce Inc becomes aware of a security breach which has resulted or may result in unauthorized access, use or disclosure of personal information KnoCommerce Inc will promptly investigate the matter and notify the applicable Supervisory Authority not later than 72 hours after having become aware of it, unless the personal data breach is unlikely to result in a risk to the rights and freedoms of natural persons.

14. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy policy.

15. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from our systems.

16. DO WE MAKE UPDATES TO THIS POLICY?

In Short: Yes, we will update this policy as necessary to stay compliant with relevant laws.

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification.
